The compromised data may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Names<\/li>\n\n\n\n<li>Addresses<\/li>\n\n\n\n<li>Emails<\/li>\n\n\n\n<li>Dates of birth<\/li>\n\n\n\n<li>Health care providers<\/li>\n\n\n\n<li>Dates and types of health care services<\/li>\n\n\n\n<li>Medical record numbers<\/li>\n\n\n\n<li>Immunization types<\/li>\n\n\n\n<li>Lab results<\/li>\n\n\n\n<li>Medications<\/li>\n\n\n\n<li>Payments, payer names and claims information<\/li>\n\n\n\n<li>Social Security numbers<\/li>\n\n\n\n<li>Credit card information<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Who are the class members?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Class members must meet all of the following criteria:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>They received a direct mail notice from Trinity Health Corp. about the data security incident that occurred on or about Jan. 20, 2021.<\/li>\n\n\n\n<li>The settlement administrator addressed the notice to a California address.<\/li>\n\n\n\n<li>The incident may have impacted their data.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The settlement affects approximately 18,153 California residents.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How much can class members get?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Class members who submit a valid and timely claim form can receive a pro rata cash payment and may also claim reimbursement for documented out-of-pocket losses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The&nbsp;<strong>pro rata cash payment<\/strong>&nbsp;is estimated to be:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>$231 if 5% of class members submit claims<\/li>\n\n\n\n<li>$115 if 10% of class members submit claims<\/li>\n\n\n\n<li>$11 if 100% of class members submit claims<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Class members may also claim up to $1,000 for documented,&nbsp;<strong>out-of-pocket losses or expenditures<\/strong>&nbsp;fairly traceable to the data security incident. These may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Losses from documented identity theft or fraud<\/li>\n\n\n\n<li>Card cancellation or replacement fees<\/li>\n\n\n\n<li>Credit-related costs, such as for credit reports, credit monitoring or identity theft protection<\/li>\n\n\n\n<li>Costs to place a freeze or alert on credit reports<\/li>\n\n\n\n<li>Costs to replace a driver\u2019s license, state identification card or Social Security number<\/li>\n\n\n\n<li>Late, declined payment, overdraft, returned check or customer service fees attributable to documented identity theft or fraud<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If the total amount class members claim for out-of-pocket losses exceeds the available settlement funds, the settlement administrator may reduce payments on a pro rata basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If any money remains in the net settlement fund more than 120 days after the settlement administrator distributes payments, it may make a subsequent payment to all class members who cashed or deposited their initial pro rata cash payment provided the average payment amount is equal to or greater than $10. Following this second distribution, the settlement administrator will distribute any amount remaining in the net settlement to the nonprofit residual recipient.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How to claim a class action payment<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Class members can&nbsp;<a href=\"https:\/\/forms.ksacms.com\/efiling\/fr\/eform\/trinityhealthclassclaim_claimform\/new\" target=\"_blank\" rel=\"noreferrer noopener\">file a claim online<\/a>&nbsp;or download, print and complete the&nbsp;<a href=\"https:\/\/trinityhealthclassclaim.com\/files\/JaneDoevTrinityHealthCorp_SettlementAgreement.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">PDF claim form<\/a>&nbsp;(Page 62 of the settlement agreement) and mail it to the settlement administrator.
